Important Notice about Availability of Volvo Vehicles

Volvo Cars is experiencing disruptions and delays to its supply chain. This impacts its ability to produce and sell cars to customers around the world, including in Australia. These disruptions can cause delays to delivery times for its vehicles, changes to specifications and production volume. This means that the vehicle you want may not be available and a Retailer may offer you the option to order a later model year. If that is the case, the specification and price may change from that displayed on the Volvo Cars website or communicated by the Retailer at the time of order and there may be a longer wait time for deliveries. Volvo Car Australia Pty Ltd (A.C.N. 004 830 611) (“Volvo Cars”) offers customers the ability to view and configure selected Volvo vehicles and submit an enquiry about ordering a Volvo vehicle from an authorised Volvo Car dealer through the Volvo Car Australia website www.volvocars.com/au (“Website”) (“Service”).

By using the Service to place an order enquiry with Volvo Cars you agree to be bound by these Terms and Conditions. These Terms and Conditions apply specifically to your use and receipt of the Service. To use the Service you must be aged over 18 years and a resident of Australia.

The Service allows you to:

(i) configure the Volvo vehicle you would like to enquire about (“Selected Vehicle”);

(ii) nominate the authorised Volvo Cars dealer with which you wish to explore your purchase and test drive options for the Selected Vehicle with (“Retailer”); and

(iii) provide your contact details so that the Retailer or Volvo Cars Customer Relations Centre may contact you directly regarding your enquiry as further described below.

The Service does not permit you to place an order for, or purchase, a vehicle.

Volvo Cars will share information about the Selected Vehicle, your contact details and other information you have provided by using the Service with the Retailer. Once your order enquiry has been received, the Retailer or a Volvo Cars’ representative will contact you to discuss your Selected Vehicle or an alternative vehicle in the event the vehicle for which you have registered your interest is not available.

To buy the Selected Vehicle, or an alternative vehicle, you will need to:

1. visit the Retailer;

2. agree a purchase price with the Retailer;

3. place an order and sign a contract of sale with the Retailer; and

4. pay the Retailer a deposit and secure appropriate financing for the final payment.

Inclusions

• 100,000km or 3 year service (whichever occurs first)
• 5 year unlimited km warranty
• 8 years roadside assistance

• compulsory third party insurance (CTP)
• options entered during the customer journey
• applicable statutory fees and charges
Registration fees are in accordance with applicable state/territory legislation, for vehicles fitted with a premium licence plate and based on private ownership.

Exclusions

comprehensive motor insurance policy or a vehicle wallbox, which are optional and will need to be purchased separately

Variables

The price of some of the charges shown in the price breakdown/price summary are set by third parties, are subject to change and have been estimated based on the postcode you provided.

Neither Volvo Cars nor the Retailer set third party fees and charges. The actual drive away price you pay will be agreed by you with the Retailer and set out in the vehicle sale agreement between you and the Retailer.

The price and specification of the Selected Vehicle are subject to change.

Additional terms and conditions apply to the service, warranty and roadside assistance and are available from your Retailer or the Volvo Car Australia Customer Relations Centre.

Purchase from an authorised Volvo Cars Dealer

Placing an order enquiry does not guarantee you can purchase the Selected Vehicle at the price stated, nor does it oblige you to purchase a vehicle. Due to the current supply chain challenges, the model year for the Selected Vehicle may not be available. If that is the case, you can choose to place an order for a later model year. You acknowledge and agree that there may be a difference in specification and price for a later model and that longer delivery times may apply.

Privacy

Volvo Cars collects the personal information you provide on the Website for the purposes of providing the Service, and if applicable, processing your order enquiry.

If you do not provide all the information that Volvo Cars requests, Volvo Cars may not be able to provide you access to the Service, or you may not be able to use all the features of the Website. General Terms

By using the Service you represent and warrant that all information you provide is true and accurate. If at any time Volvo Cars discover that any of the information you have provided is not true or not accurate, Volvo Cars reserves the right to cancel your enquiry for the Selected Vehicle.

Any costs associated with accessing our Website are your responsibility and may depend on the Internet service provider used.

There are certain guarantees, warranties and rights imposed by law in relation to our Service which cannot be excluded, restricted or modified or may only be limited to a certain extent (“Statutory Obligations”). Nothing in these Terms and Conditions excludes, restricts or modifies the Statutory Obligations. Except to the extent set forth in these Terms and Conditions, and to the maximum extent permitted by law, Volvo Cars otherwise excludes all liability for any loss (including any damage, claim, injury, cost or expense, including loss of opportunity) which you may suffer or incur in connection with the Service, including but not limited to any technical difficulties or access issues with the website (whether or not under our control) except where that loss has been caused by Volvo Cars’ gross negligence.

Volvo Cars reserve the right to cancel the Service or change the offer for any reason and at any time.

These Terms and Conditions are governed by the laws of New South Wales and the parties submit to the exclusive jurisdiction of those courts.
