AGREED TERMS

The definitions and rules of interpretation for the following Terms & Conditions (“Terms and Conditions”) are as follows:

  • “Agent” refers to persons, contractors, service providers, match referees, linesmen, volunteers and agencies appointed by the Organiser and/or the Event Partner(s) to facilitate the organisation of the Tournament.

  • “Event Partner(s)” refers to ASCARO Courts Kuala Lumpur Sdn Bhd with Registration No. 202201023443 [1469140-K] located at Lot UR601, 1Utama City Centre, 1, Lebuh Bandar Utama, Petaling Jaya 47800 Selangor, Malaysia (“ASCARO”); Padelground Malaysia Sdn Bhd with Registration No. 202201032444 [1478141-H] located at 3, Jalan Bukit Kiara 1, Bukit Kiara, 60000 Kuala Lumpur, Wilayah Persekutuan Kuala Lumpur, Malaysia (“Padelground”); and/or PadelKL Sdn Bhd with Registration No. 202301005161 [1499080-V] located at 06-16A, Berjaya Times Square, 1, Jln Imbi, Imbi, 55100 Kuala Lumpur, Wilayah Persekutuan Kuala Lumpur, Malaysia (“PadelKu”), who are the participating padel court operators for the Tournament.

  • “Food and Beverage Partner(s)” refers to either NOA at The Courts, KLCC Resort, Paloma by Ascaro at 1 Utama Shopping Centre, Bandar Utama, or PadelKu at Berjaya Times Square

  • “Organiser” or “the Organiser” refers to Volvo Car Malaysia Sdn Bhd with Registration No. 199901007530 [482430-K] with its business address at Lot 01-13A, 13A Floor, Menara Symphony, 5, Jalan Professor Khoo Kay Kim, Seksyen 13, 46200 Petaling Jaya, Selangor, Malaysia.

  • “Participant” refers to individuals taking part in the Tournament that have completed the registration process.

  • “The Volvo Experience” shall mean the loan of a fully electric Volvo C40 Recharge Pure Electric or Volvo XC40 Recharge Pure Electric between 16 June 2024 to 31 December 2024, subject to availability of cars and dates at the full discretion and schedule of the Organiser.

  • “Tournament” or “the Tournament, refers to the Volvo Padel Open 2024 to be held between the 8th to the 15th of June 2024.

GENERAL

  1. The Organiser reserves the right to unilaterally add on, modify or substitute any of the terms and conditions below at any time as it deems fit without prior notice. If there is ambiguity in any of the provisions of the Terms and Conditions, the Organiser shall have sole discretion to interpret the ambiguous provision(s) as it deems fit.

  2. If you cannot accept these Terms and Conditions or the risks associated with the Tournament, please do not proceed further with registration for this Tournament. By participating in the Tournament, you have read and understood the rules and regulations of the Tournament as released from time to time and agree to participate on the understanding that you must adhere to all the rules and regulations stipulated.

  3. By participating in the Tournament, you acknowledge you have read and agreed to all the provisions in the Terms and Conditions for the Tournament. The Organiser reserves the right to refuse, disqualify or restrict you from participating in the Tournament and/or accessing the entitlements of the Tournament and claims thereto.

TOURNAMENT REGISTRATION

  1. Registration for the Tournament can only be done via the official website at https://padel.volvocarmalaysia.com. No registration is allowed via email, mobile communications, or direct communications with the Organiser, Event Partner(s), and/or Agent(s).

  2. The following persons are not allowed to participate in the Event:
    a) Directors and employees of the Organiser and the Event Partners and their immediate families;
    b) Contractors, affiliates, appointed agents or agencies, business partners, suppliers, and representatives of the Organiser and/or the Event Partners and their immediate families;
    c) Professional padel players and coaches;
    d) Registrants below the age of eighteen (18) years of age, and/or,
    e) Pregnant players.

  3. Registration for the Tournament can be done between Wednesday, 1st of May 2024 and Friday, 24th of May 2024, or until available Tournament slots are fully filled.

  4. The Organiser reserves the right to close registration early and/or move new registrations into a waitlist if the Tournament slots are filled.

  5. Registrants shall have twenty-four (24) hours from the time of account creation to complete the process and make full payment for the Tournament Registration, otherwise the Tournament slot will be released to other registrants in the queue.

  6. Registrants on the waitlist are not considered Participants until they have been directly contacted by the Organiser and/or its Agents to complete the registration process.

  7. The following details will be collected as part of the registration process:
    a) Full name, email address, mobile phone number, national identification number or passport number and digital copy thereof, gender, t-shirt size of the registrant and their teammate/partner.; and
    b) a self-assessment of the registrant’s padel-playing ability, whether as a Beginner (below Level 3) or Intermediate (Level 3 and above).

  8. It is the registrant’s sole responsibility to obtain their teammate/partner’s consent to submit the teammate/partner’s information before submitting the teammate/partner’s information on behalf of the teammate/partner during the registration process.

  9. Volvo owners are additionally required to submit their Vehicle Identification Number (“VIN”) and car model to be entitled to a special registration fee.

  10. Eligible categories will be presented during registration based on gender and level self-assessments:
    a) The Open category is an available option only if both Participants are Beginner Players.
    b) The Intermediate category is the only available option if one or both Participants in a team is an Intermediate Player.
    c) The Women’s category is an available option if both Participants are women, regardless of skill level.

  11. The Participant warrants and agrees that all information provided by the registrant during the registration process for this Tournament shall be true, accurate, current, and complete information. If at any point of time, the Organiser has grounds to believe that such information provided by the Participant is untrue, inaccurate, obsolete, or incomplete, the Organiser may disqualify, suspend, or cancel the Participant’s registration without any disputes nor refunds of the registration fee.

  12. The Organiser shall not entertain nor be in any way responsible for any disputes, discrepancies or complaints arising from incomplete or inaccurate entry details by the Participant during the registration process.

  13. Registration for the Tournament shall only be deemed confirmed upon receipt of full payment and upon issuance of a confirmation email by the Organiser and/or its Agents.

  14. Payments are processed by an authorised Agent of the Organiser through a secure, third-party payment gateway. All transactions are in Ringgit Malaysia and may be subject to currency exchange differences to be borne by the Participant if making payment via a foreign bank or credit card. The Organiser and/or its Agent(s) shall not be liable for any financial loss by Participants resulting from the misuse of said payment gateway.

PARTICIPATION FEES, NO-REFUND POLICY, AND PLAYER SUBSTITUTIONS

  1. Registration fees are MYR200 per team of two (2) players, or MYR100 per team of two (2) players if at least one Participant is a Volvo car owner, verified through the submission of the Volvo car model and Vehicle Identification Number (“VIN”) during the registration process.

  2. The Organiser reserves the right to deny the MYR100 special rate for Volvo car owners if the VIN is found to be duplicated, erroneous, or not registered in Malaysia.

  3. No refunds will be given for whatsoever reason once registrations have been successfully processed by the Organiser. This includes but is not limited to Player withdrawals, walkovers, disqualifications, and forfeitures before or during the Tournament, or personal circumstances or reasons that prevents the Participant from participating in the Tournament and/or claiming Tournament entitlements.

  4. Participants are strictly not allowed to transfer, sell, or swap their entries to another party nor change categories after their registrations are confirmed.

  5. Teams are allowed a one-time player change between the start of registrations from Wednesday, 1 May 2024 to 5:00pm on Friday, 24 May 2024 through their team registration number at this link https://padel.volvocarmalaysia.com/.

  6. The Organiser reserves the right to revoke participation otherwise or to place the registered team under the waitlist. No substitutes shall be allowed after the Grace Period.

  7. While there are strictly no refunds, Participants who cannot play in the Tournament for whatever reason shall still be entitled to collect their official sports kit at their chosen Event Partner, subject to availability, and are still entitled to access to the event and hospitality during the Tournament finals at ASCARO on 15th June 2024.

TOURNAMENT CATEGORIES & GAMEPLAY

  1. All matches in the Tournament are played in doubles format only according to the prevailing rules and regulations of the padel sport as determined by the Organiser, with the following categories (see table below).

  2. Team groupings will be set in order of registration sequence by the Organiser, or by other means best suited for equal distribution and fairness in the tournament format.

  3. Participants shall be able to view their groupings at the official Tournament leaderboard at https://padel.volvocarmalaysia.com by the 30th of May 2024.

  4. Participants are required to be at the venue (refer to Key Dates and your confirmation email for the Venue) between 9am to 7pm on the day and present themselves to the Organiser, Event Partner(s) and/or the Agents at least 15 minutes before the estimated start of their matches.

  5. Unlike professional tournaments, matches can be played with a custom scoring system within a set time predetermined by the Organiser and depending on the progression of the Tournament, to facilitate timeliness and a chance for all Participants to play. Participants will be briefed on the scoring and timeframe for matches prior to gameplay.

  6. The Organiser, Event Partners and/or Agents shall provide umpires/linesmen and scorekeepers throughout matches, but it is also the responsibility of Participants to keep score and call out faults, unforced errors and forced errors in fairness and the spirit of proper sportsmanship.

  7. In scoring or gameplay disputes, the umpire’s final decision is incontestable. Hostile escalation of disputes by Participants can result in forfeiture of the match.

  8. The Organiser reserves the right to amend gameplay and/or tournament format unconditionally and without prior notice.

MATCH FORMATS

Open Qualifiers (8th & 9th June 2024)

  • Open Qualifiers will be played with 113 teams over two (2) days and three (3) venues on Saturday, 8th June 2024 and Sunday, 9th June 2024.

  • Qualifiers will be held in a group system round-robin format, with each team playing a minimum of two (2) games. Within a group, the team with the most match wins at the end of the round-robin advances to Open Playoffs on Saturday, the 15th of June 2024 at ASCARO Padel & Social Club.

  • Games will employ a simple scoring format (0,1,2,3,4…) with points awarded for every win.

  • The team with the highest points after ten (10) minutes wins the match.

  • If both teams have the same score at ten (10) minutes, the match will end with one (1) decisive winning point from either team.

  • Each team plays one match against each other in the same group, with points to be awarded as follows:
    - Win: 3 points
    - Loss: 0 points

  • The ranking in each group is determined in the following order:
    - Most number of wins obtained in the group;
    - Point difference across all group matches (total points scored minus points conceded);
    - Most number of points scored across all group matches;
    - Least number of points conceded across all group matches;
    - Coin toss to serve and play for one (1) decisive point.

  • The Open Qualifiers will produce a total of thirty-two (32) winning teams with the breakdown of the teams as follows:
    - Day 1: ASCARO: Eight (8) winners
    - Day 1: Padelground: Six (6) winners
    - Day 1: Padelku: Four (4) winners
    - Day 2: ASCARO: Six (6) winners
    - Day 2: Padelground: Three (3) winners
    - Day 2: Padelku: Two (2) winners
    - Three (3) second best teams from ASCARO & Padelground

  • The three second-best teams from ASCARO & Padelground are selected based on the criteria as follows:
    ASCARO Day 1
    - Second-most number of wins obtained across all groups in Day 1
    - Second-most point difference across all groups in Day 1;
    - Second-most number of points scored across all groups in Day 1.
    ASCARO Day 2
    - Second-most number of wins obtained across all groups in Day 2
    - Second-most point difference across all groups in Day 2 ;
    - Second-most number of points scored across all groups in Day 2.
    Padelground
    - Second-most number of wins obtained across all groups in Day 1 and Day 2;
    - Second-most point difference across all groups in Day 1 and Day 2;
    - Second-most number of points scored across all groups in Day 1 and Day 2;

  • If two or more teams are equal based on the above criteria, the second-best rankings will be determined as follows:
    - Second-lowest number of points conceded across all group matches;
    - Coin toss to serve and play for one (1) decisive point.

Open Playoffs (15th June 2024)

  • The Open playoffs will start with thirty-two (32) teams on Saturday, 15th of June 2024.

  • All matches will be played via elimination.

  • Games will employ a simple scoring format (0,1,2,3,4…) with points awarded for every win.

  • The team with the most points after ten (10) minutes wins the match.

  • If both teams have the same score at ten (10) minutes, the match will end with one (1) decisive winning point from either team.

Intermediate Playoffs (15th June 2024)

  • The Intermediate playoffs will start with thirty-two (32) teams on Saturday, 15th June 2024.

  • All matches will be played via elimination.

  • Games will employ a simple scoring format (0,1,2,3,4…) with points awarded for every win.

  • The team with the most points after ten (10) minutes wins the match and proceeds to the next level.

  • If both teams have the same score at ten (10) minutes, the match will end with one (1) decisive winning point from either team.

Women’s Playoffs (15th June 2024)

  • The Women’s playoffs will start with sixteen (16) teams on Saturday, 15th June 2024.

  • All matches will be played via elimination.

  • Games will employ a simple scoring format (0,1,2,3,4…) with points awarded for every win.

  • The team with the most points after ten (10) minutes wins the match and proceeds to the next level.

  • If both teams have the same score at ten (10) minutes, the match will end with one (1) decisive winning point from either team.

Finals – Open, Intermediate and Women’s categories (15th June 2024)

  • The final match for the Open, Intermediate and Women’s categories will be played with standard padel scoring, similar to tennis (0, 15, 30, 40…).

  • If in a game, both teams are tied at game point at 40/40 (“40-all” or “deuce”), the match will end with one (1) decisive winning point from either team (“golden point”). No deuces (i.e., a two (2) point lead to win the match) will be played.

  • The first team to win six (6) games wins the set. The first team to win two (2) out of three (3) sets wins the match. Each set has no tiebreaker.

PRIZES

  1. The Organiser is offering cash prizes, merchandise, and loans of fully electric Volvo cars worth up to MYR100,000 to the winners of the Tournament.

  2. The “winner”, “winners”, or the “winning team” shall be the champion and the 1st runner up teams of each category, with the prizes and the total prize values for each respective winner of each category are broken down as follows (see table below).

  3. The value of cash prizes and merchandise are per team of two (2) players.

  4. All winners are required to produce a valid identification document and sign an acknowledgment document upon collection of prizes.

  5. Cash prizes will be paid to the main registrant of each winning team by Wednesday, 31 July 2024. Winners will be contacted by the appointed Agent of the Organiser (LAB Activation Sdn Bhd with Registration No. 201401011867 [1087944-H]) to arrange for payment to a bank account of the winners’ choice. Transactions will be in Ringgit Malaysia and the Organiser and/or its Agents are not liable for any additional transaction fees and/or foreign exchange rates imposed by the winners’ chosen bank.

  6. Merchandise consists of official Volvo premiums which will be awarded to winners after the Tour prize giving ceremony on Saturday, 15th June 2024 and cannot be exchanged for cash, cash equivalents or any other emolument.

  7. Winners are entitled to one (1) Volvo Experience loan per player for up to fourteen (14) calendar days for champions, or seven (7) calendar days for 1st runners-up.

  8. The Volvo Experience shall only be available for the Winners and cannot be exchanged for cash, cash equivalents or any other emolument, nor transferred to an individual other than the winners, except with a written request from the winner(s) followed by the Organiser’s agreement in writing (“Loanee”).

  9. To be eligible for the Volvo Experience, the Loanee must be twenty-five (25) years or older and hold a valid and unrestricted Malaysian driver’s licence or international driver’s licence which is valid for use in Malaysia. The Loanee must contact the Organiser to arrange for car availability and scheduling via the following personnel from the Volvo Car Malaysia’s Marketing & PR team:

  10. The Loanee shall be required to sign a Vehicle Loan Agreement prior to the Volvo Experience.

  11. The Loanee shall be responsible to collect the loan vehicle for the Volvo Experience at the Organiser’s business address at Menara Symphony, 5, Jalan Professor Khoo Kay Kim, Seksyen 13, 46200 Petaling Jaya, Selangor, Malaysia during business hours of 9am to 5pm from Monday to Friday except public holidays.

  12. Except for any liability that cannot be excluded by law, the Organiser (including its respective officers, employees, and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special, or consequential, arising in any way out of the Participant’s participation in this Tournament or the Winners’ usage of the Volvo Experience.

  13. The Organiser reserves the right without prior notice to vary the prizes with items of equivalent value if the prizes listed are not available.

  14. The Organiser shall not entertain any dispute or appeal regarding the results after the prize presentation ceremony of the Tournament.

  15. Prizes must be taken in the forms as presented by the Organiser. They are not transferable or convertible and are subject to the rules and regulations or decisions as determined by the Organiser.

ATTIRE & ETIQUETTE

  1. The official Volvo Padel Open t-shirt included in the Participants’ sports kit must be worn during matches.

  2. Only one (1) t-shirt will be given per Participant. It is the Participants’ responsibility to maintain the t-shirt between matches and match dates. Any request to change t-shirt sizes after the registration process will not be entertained.

  3. Participants should wear comfortable sports bottoms during matches (e.g., tennis shorts, track pants or tennis skirts), and comfortable, durable sports shoes during matches. Open-toe footwear, slippers, flip-flops, sandals, and bare feet are not allowed.

  4. During Tournament days, participants will be given wrist tags to identify their team number and category. These tags must not be removed or transferred to another individual throughout the day. The Organiser reserves the right to re-verify Participants’ identities by asking Participants to present a valid identification document at any time.

  5. Participants shall be solely responsible for the safekeeping of their personal belongings and the Organiser, Event Partners and/or Agents shall in no way be held responsible for any loss of or damage to personal property as a result of participation in the Event.

  6. Participants shall always uphold good sportsmanship both on-court and off-court. The Organiser reserves the right to disqualify the Participant(s) who engages in the use of abusive, offensive, harassing, threatening or inappropriate language in any way, shape and form directed to the Organiser, Event Partner(s), their Agents, and/or or other Participants via personal interaction, email, mobile phone communications, and social media platforms, both before and during the Tournament.

  7. Only Participants and their registered guests are allowed access to the Tournament venue(s) and hospitality therein. The Organiser, Event Partner(s) and/or its Agents reserve the right to refuse entry to any and all unregistered guests may be accompanying Participants.

SPORTS KIT COLLECTION

  1. The official Volvo Padel Open sports kits can be collected from 25th May, 2024 to 15th June, 2024 at the Event Partners’ venues (ASCARO, Padelground, PadelKu).

  2. Participants must collect the sports kit in person and present a valid identification document during collection. Collection by a third party on a Participant’s behalf must be accompanied by a copy of the Participant’s valid identification document.

  3. Participants shall only be allowed to collect the sports kit at the chosen Event Partner venue and shall not be allowed to collect the sports kit at a different Event Partner venue from the venue selected during the registration process.

  4. The sports kit contains the official Volvo Padel Open t-shirt that must be worn during all games.

  5. The sports kit also contains one (1) voucher worth MYR30 from any one of the Food and Beverage Partners and is only redeemable for food and beverage menu items purchased from the respective venues from 8th to 9th June 2024 (“Voucher”).

  6. The Voucher must be presented upon payment and shall only be used on a single receipt, with one redemption per customer per transaction. Vouchers cannot be stacked for cumulative value. If the value of the transaction is an amount exceeding the Voucher’s value, the excess shall be borne by the Participant. If the value of the transaction is less than the Voucher’s value, the excess amount of the Voucher’s value shall be forfeited and not carried forward to the next transaction.

  7. This Voucher cannot be exchanged for cash or cash equivalents, discounts on padel equipment and court credits from the Event Partner(s) or the Organiser of the Tournament, or any other emolument from the Event Partner(s), the Food and Beverage Partners or the Organiser.

  8. The Food and Beverage Partners reserve the right to refuse redemption, i.e., unavailable/sold out items on the menu without prior notification.

  9. No Voucher may be copied, reproduced, or distributed in any form or by any means for use by a person other than the original recipient.

  10. Neither the Organiser, its Event Partners nor Food and Beverage Partners shall be liable to the recipient for any financial loss arising out of refusal, cancellation or withdrawal of any voucher or any failure or any failure or inability of a recipient to use a voucher for any reason.

COACHING CLINICS

  1. Coaching clinics will be offered during the registration process to Open and Women's category Participants only (Beginners below Level 3) on a first-come, first-served basis. Participation is complimentary.

  2. Coaching clinics will be held on the 1st and 2nd of June 2024 at ASCARO, Padelground and PadelKu, with twelve (12) Participants per court per session with a duration of one (1) hour.

  3. Clinic sessions are held from 9:00am, 10:00am, 3:00pm, 6:00pm, and 7:00pm.

  4. Participants are not allowed to attend more than one (1) clinic session per registration.

  5. Participants are required to present a valid identification document matching their registered name upon arrival. Clinic sessions are not transferable to another party and cannot be carried forward.

  6. Participants are not allowed to swap sessions without prior notice to the Organiser.

  7. The Organiser and/or its Agents reserves the right to refuse entry to Participants who have not registered for the clinic sessions, do not have a valid identification document, arrive late for their session, attend a session that they have not registered for, or are not eligible for the sessions (e.g., Intermediate level Players).

  8. Any accommodation for changes in clinic sessions upon request by the Participant is at the sole discretion of the Organiser.

  9. The Organiser reserves the right to amend the number of Participants per clinic session, timing and/or dates without prior notice.

FORFEITURES AND DISQUALIFICATIONS

  1. Participants and teams forfeit their match and/or progress at any point during the Tournament if:
    a) One or both Players in the same team are not present at the court five (5) minutes before the start of a scheduled match;
    b) One or both Players in the same team decide not to continue their participation in the current match, the next match and/or the remainder of the Tournament (“walkover”);
    c) One or both Players in the same team have a medical condition, injury or disability that prevents them from participating safely, in which case participants must inform the umpire/Organiser/Event Partner/Agent(s) immediately if they are feeling unfit to play;
    d) The umpire/Organiser/Event Partner/Agent(s) have reasonable grounds to believe that a Player has a medical condition, injury or disability that prevents them from participating safely, and which may pose physical and mental risks to themselves and other Participants; and/or,
    e) Any other reasons caused by a Participant that prevents, delays, or challenges the progress and/or timely continuation of the Tournament.

  2. Any forfeitures of a Player or team automatically awards a match win to the opposing team.

  3. The Organiser, Event Partner(s) and/or Agents may also disqualify Participants without compensation or refunds, prior and during the Tournament, on the following grounds:
    a) The use of abusive, offensive, harassing, threatening or inappropriate language in any way, shape and form directed to the Organiser, Event Partner(s), Agents, and/or other Participants via personal interaction, email, mobile phone communications, and social media platforms, both before and during the Tournament;
    b) Suspicion of cheating, doping, or any means that Participants may employ to gain an unfair advantage over opponents, contrary to the spirit and rules of the sport of padel;
    c) Unauthorised Participant substitutions and/or false declarations of personal identity and physical ability that directly or indirectly affect Participant’s individual rankings and the categories that the Participant has registered for; and/or,
    d) Unsportsmanlike behaviour as determined by the Organiser, Event Partner(s), and/or Agents.

  4. The Organiser also reserves the right to limit and/or refuse entry to any persons to the Tournament or premises of the Event Partners during the Tournament without giving any reason and/or notice.

PARTICIPANT SAFETY & HEALTH

  1. Whilst every reasonable precaution will be taken by the Organiser to ensure the Participants’ safety, you agree that you are competing at your own risk. The Organiser shall not be held responsible or liable for any injury or death arising directly and/or indirectly from training in preparation for the Tournament and/or participation in the Tournament.

  2. You are strongly encouraged to go for a medical check-up and/or consultation with your medical practitioner prior to registration and/or at any time from the date of registration until the date(s) of the Tournament to satisfy yourself of your physical and mental fitness to participate in the Tournament.

  3. You are encouraged to have adequate personal accident and injury insurance coverage before participating in the Tournament.

  4. Participants are not allowed to play in the Tournament if they are pregnant. The Organiser shall not be held responsible or liable for any complications arising from participation and reserves the right to disqualify Participants from matches or prizes for false declarations.

  5. While alcoholic beverages are available for purchase at the venue or locality of the Event Partners, Participants agree and warrant that they shall not drink and drive. If Participants choose to drink alcoholic beverages at the Tournament, it is the Participant’s sole responsibility to arrange for a safe means of transportation such as a taxi, e-hailing, or ridesharing with a designated driver after the Tournament.

  6. If you suffer from any of the medical conditions stated below, you are not allowed to participate in this Tournament:
    a) Congenital or rheumatic heart conditions;
    b) Hypertension;
    c) Myocarditis and other heart conditions;
    d) Coronary heart disease and/or coronary arterial disease;
    e) Serious arrhythmia;
    f) Diabetes;
    g) Vertigo; and,
    h) Any other disease which can be aggravated by intense physical exertion.

  7. No exceptions shall be made for Participants with any of the above medical conditions. The Organiser reserves the sole right to allow or disqualify Participants with any medical conditions other than as listed above.

TOURNAMENT CANCELLATION

  1. While every precaution will be taken to ensure the success of the Tournament, the Organiser reserves the right to cancel the Tournament in part or in full for reasons beyond reasonable control of the Organiser, its Event Partners, and/or its Agents, including a force majeure circumstance including but not limited to:
    a) Acts of God, flood, drought, air pollution (haze), earthquake or other natural disaster;
    b) Epidemic or pandemic;
    c) Terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations;
    d) Nuclear, chemical or biological contamination;
    e) Any law or any action taken by a government or public authority, including without limitation imposing an export or import restriction, quota or prohibition;
    f) Collapse of buildings, fire, explosion or accident;
    g) Any labour or trade dispute, strikes, industrial action or lockouts; and
    h) Interruption or failure of utility service.

  2. If the Tournament has been cancelled for the reasons abovementioned, the Organiser reserves the right to cancel the event in part or in full for any other reason not stated above.

APPEARANCE RELEASE

  1. By participating in this event, the Participant authorises the Organiser, its subsidiaries and related corporations, including the Volvo Car Group of companies, to make use of the Participant’s likeness and appearance in its marketing materials.

  2. The Participant agrees that the Organiser may film and/or photograph his/her likeness, and record his/her voice, conversation and sounds, including any performance, in connection with his/her appearance. The Participant understands that the Organiser will be the sole owner of the results and proceeds of such filming, photographing, and recording (“Materials”) with the exclusive right, throughout the world, including copyright, to use and to license others to use all or any portion of the Materials, whether in connection with the Event or otherwise.

  3. The Participant further agrees that Volvo Cars may use and license others to use the Materials, his/her name, voice, likeness for promotion, advertising, sale, re-creations of events in connection with the Event or otherwise throughout the universe, in all media and social media (including Facebook, Instagram, LinkedIn and YouTube), now known or hereafter devised, in perpetuity. The Participant waives the right to inspect or approve versions of my image used for publication that may be used by the Organiser.

  4. The Participant acknowledges that the Organiser will rely on this permission, potentially at substantial cost to the Organiser, and the Participant agrees not to assert any claim of any nature whatsoever (including any claims for injunctive relief or money damages, all of which the Participant hereby knowingly waives) against anyone relating to the exercise of this permission or to the use of the Materials by the Organiser, or with the consent of the Organiser.

  5. The Participant agree to release, defend, indemnify and hold the Organiser harmless from any and all claims, demands, costs (including legal fees) and causes of action of any kind or nature whatsoever now and in the future, including without limitation defamation, bodily harm, infliction of emotional distress and invasion of privacy, arising out of or in connection with my appearance, statements or actions in or in connection with the Event.

  6. The Participant consents to the processing of his/her personal data by the Organiser in accordance with, the Organiser’s Personal Data Protection Act Notice and Consent that can be accessed here.

  7. This Terms and Conditions, and all issues arising out of it shall be governed by the laws of Malaysia and all disputes shall be referred exclusively to the courts of Malaysia.

  8. The participant confirms he/she is at least 18 years of age and competent to contract in his/her own name.

WAIVER CLAUSE

In consideration of the acceptance of your participation, you, your heirs, successors and assignees, do hereby unconditionally and irrevocably waive and release the Organiser, the Event Partners, the Agents, as well as all persons, contractors, agents, service providers, volunteers and agencies connected from all complaints, demands, claims, liabilities, proceedings, suits, losses and/or damages of any kind whatsoever due to or relating to or arising directly or indirectly out of your participation in the Tournament, including without limitation, personal injury and/or death.
